The Tent of Sadness- a Model

Abstract

This study aims to clarify that the Islamic Sharyiah is characterized by wideness, flexibility and ability for coping with human development and time and place changes. That is, the legal texts (Nosous Sharyiah) are fixed but life and people issues are unlimited and increasing. The change in conditions and statuses has a significant influence on the new legal regulations (Ahkam Sharyiah). Therefore, the researchers concludes that issuing the regulations (Ahkam) is based on considering people affairs; and what is useful is required and what is harmful is prohibited. This is an original principle for Muslim Fukahaa (knowledgeable elite in religion issues and instructions). The tent of sadness is one of the Almasalih Almonzalah concerns with reasonable issues and is useful for Muslims.
