This research aims to identify the general concept of the illegal migration and asylum seeking, their reasons and effect and the relevant international laws. The analytic approach has been used in this study. It is concluded that there is no consensus about the concepts of these two phenomena; despite the agreement about their reasons and effects. It is also concluded that the existing international legal laws of illegal migration and asylum seeking were issued to systemize these two phenomena separately and differently. There is a need for establishing international agreement through the United Nations for issuing international criteria showing the rights and commitments of each group. This agreement and criteria should be respected by all countries.
